Andrade Gutierrez signs leniency agreement with CGU and AGU

On Tuesday, the 18th, Andrade Gutierrez entered into a leniency agreement with the CGU – Comptroller General and AGU – Attorney General of the Union.

With the closing of the agreement, the actions of misconduct and administrative proceedings filed by the government against the contractor will be terminated.

As stated in the term, the company has made a commitment to pay R$ 1.49 billion to the public coffers. The value, adjusted by the Selic rate, will reach R$ 3.6 billion.

The amount to be reimbursed is related to fraud in 54 contracts involving Federal public funds, and comprises the profit improperly obtained by the company through the contracts (R$ 875 million), refund of fees paid to public agents (R$ 328 million) and fines (in the amount of R$ 286 million) provided for in the anti-corruption law (law 12.846/13) and in the administrative misconduct law (law 8.429/92).

According to AGU, most of the money will go to Petrobras, the one most injured by the illicit activities.

In a statement, Andrade Gutierrez said he supports the entire anti-corruption initiative, aimed at clarifying and repairing past events, including compensation for damages. Andrade Gutierrez reinforced that it made this public commitment to society in the manifesto published in the main newspapers of the country in order to apologize for the events that occurred, and continues to collaborate intensely with the Justice.

The construction company also says it has incorporated actions to ensure ethics, fairness and transparency in its business relationships, whether with customers or suppliers. “Anything that does not follow strict ethical standards will be immediately rejected by the company,” says the construction company.

On the company’s side, the negotiations were conducted by Sebastião Tojal, partner of Tojal | Renault Advogados.
